Smart & Biggar is thrilled to share that six of our leading IP litigators have been featured in this year’s Lexpert Special Edition: Litigation 2023.
Lexpert’s Special Edition: Litigation, published online and in the Globe and Mail’s Report on Business Magazine, recognizes the expertise of Canada’s leading litigators identified as “most recommended” in Lexpert’s annual survey of thousands of respected lawyers, corporate counsel and other legal and business professionals.
We congratulate our recognized lawyers and Principals Mark Evans, Steven Garland, François Guay, Sheldon Hamilton, Yoon Kang, and Nancy Pei for their inclusion in this special edition, reflecting their outstanding achievements as recognized by their clients, peers and colleagues.
Notably, Smart & Biggar was also featured in Canada's “Top 10 business decisions”, for our successful representation of the respondents in the Nova Chemicals Corp v Dow Chemical Co case before the Supreme Court of Canada (SCC). In an 8-1 majority ruling, the SCC affirmed the record-setting $645M patent infringement award wherein Nova was ordered to pay Dow a quantum of its profits for infringement of its patent on novel polyethylene blends. This was and remains the largest reported Canadian patent infringement award in history. Dow was represented by the firm’s award-winning litigation team including Steve Garland, Jeremy Want, Daniel Davies, Matthew Burt and Nicole Boyle.
