A few months after unsuccessfully defending an action for copyright infringement brought by Smart & Biggar's client Groupe TVA in the Federal Court and the Federal Court of Appeal (2022 CF 256; 2023 CAF 92; 2023 CF 741) which resulted, inter alia, in a permanent injunction preventing Coopérative de Câblodistribution Hill Valley ("Hill Valley") from retransmitting the popular TVA Sports television station to their clients without authorization from Groupe TVA, Hill Valley sought an injunction from the Superior Court of Québec to essentially circumvent the permanent injunction issued by the Federal Court and force Groupe TVA as well as Bell Media to grant licences on their respective sports stations, TVA Sports and RDS. Smart & Biggar successfully represented the Defendants in having the Court dismiss Hill Valley's request for an injunction.
